Please carefully read these Terms of Purchase and Website Use (hereinafter: General Terms) before making a purchase on the website https://www.vinafurjan.hr. By accepting the General Terms, you confirm that you have read, understood, and agreed to our Terms of Purchase and Website Use, and that you accept the rules and conditions stated therein. If you do not agree with the General Terms, please do not use this website.

Prices
The displayed product prices are retail prices, include value-added tax (VAT), and are expressed in euros. Prices are subject to change. The displayed prices do not include shipping, delivery, or postal service costs, which are charged separately.
In accordance with the applicable provisions of the Consumer Protection Act, Vina Furjan may, at its discretion, offer certain products at prices lower than regular retail prices or with a special discount available under the same conditions to all users or to a specifically designated group of users.
The terms of special sales, such as the duration of the sale, quantity limits, discount amounts, etc., will be detailed on the product page. Once the period for such special sales expires, Vina Furjan cannot accept orders under the conditions that applied to the expired special sales.
Payment Methods
Bank transfer or online banking
By choosing this payment method, you will receive a proforma invoice at your email address with all necessary details for payment, including the account number to which you need to transfer the order amount. The payment can then be made using internet banking or via the bank, post office, Fina, etc. Once payment is received, we will process your purchase offer (according to bank statements – usually the next business day).
Delivery
Delivery is carried out within Croatia and other EU member states. Purchased products are delivered by DPD courier, which provides coverage throughout Croatia, including small towns and remote islands. If you purchase multiple items, you only pay for one delivery, with the price calculated based on the total weight of all products in the package. The delivery cost depends on the chosen courier service and the total weight of the products. All prices already include VAT.
Unilateral Contract Termination
ou may unilaterally withdraw from the contract within 14 days without providing a reason.
To exercise your right of unilateral withdrawal, you must notify us of your decision before the 14-day period expires, by sending a clear statement either by mail to Vina Furjan, Varaždinska ulica 68, Babinec HR-42208 Cestica, or by email to info@vinafurjan.hr. Your notice should include your full name, address, phone number, and email address. You may also use the provided sample withdrawal form, which can be downloaded, completed electronically, and submitted. We will promptly acknowledge receipt of your withdrawal notice via email.
The 14-day withdrawal period, in accordance with Article 72 of the Consumer Protection Act, begins on the day the goods are delivered to the consumer or a third party designated by the consumer, who is not the carrier. If multiple items are ordered separately or delivered in multiple shipments, the withdrawal period starts on the day the last item or shipment is delivered. For contracts involving regular deliveries over a period, the withdrawal period starts on the day the first item or shipment is delivered.
If you unilaterally withdraw from the contract, we will refund all payments received from you, including delivery costs, without delay and no later than 14 days from the day we receive your withdrawal notice, unless you have chosen a different type of delivery that is not the cheapest standard delivery offered by us. The refund will be made using the same payment method you used, or to the bank account used for payment upon delivery.
We can only issue a refund after the goods have been returned to us or after you provide proof that the goods have been sent back.
The consumer/user must return the goods without undue delay, and no later than 14 days from notifying Vina Furjan of the withdrawal in accordance with Article 74 of the Consumer Protection Act. You are considered to have met your obligation on time if you send or hand over the goods before the 14-day period expires. You are responsible for the direct costs of returning the goods in accordance with Article 77, paragraph 3 of the Consumer Protection Act.
Consumer Responsibility for Diminished Value
You are responsible for any reduction in the value of the goods resulting from handling, except for what is necessary to establish the nature, characteristics, and functionality of the goods.
In accordance with Article 75, paragraph 3, in connection with Article 77, paragraph 5 of the Consumer Protection Act, any reduction in the value of the goods caused by handling, use, assembly/disassembly, reshaping, or other use affects the right of unilateral withdrawal. Exercising the right of unilateral withdrawal requires the return of unopened and undamaged goods in their original packaging, except in cases explicitly stated as exceptions.
Exclusion of Unilateral Termination
The consumer/user may not unilaterally terminate the contract if:
- the subject of the contract is goods/services whose price depends on fluctuations in the financial market beyond the trader’s control during the right to unilateral termination
- the subject is goods made to the consumer’s specifications or clearly personalized
- the subject is perishable goods or goods with a short expiry period
- the subject is sealed goods unsuitable for return due to health/hygiene reasons if unsealed after delivery
- the subject is goods mixed inseparably with other items after delivery
- the subject is accommodation services not intended for residential use, transport services, car rental, food or beverage delivery, or leisure services agreed for a specific date or period
Complaints and Returns
The buyer has the right to return goods in the following cases:

Delivery of goods that were not ordered

Delivery of goods that are defective or damaged not caused during transport

Other cases in accordance with legal regulations
We will accept a complaint if, upon receiving the product, you notice that it is damaged in any way and immediately inform the delivery person, or if we sent a product that you did not order.
We will not accept complaints if you notify us of damage to the received product the next day or several days after receiving the package.
If the complaint is accepted, the undamaged and unopened product must be returned in its original packaging along with all accessories and documentation that were originally included.

Complaints
Users have the right to file a written complaint at Furjan winery business premises, via mail, or email. Furjan winery must promptly confirm receipt of complaints submitted in person. Furjan winery will respond within the legal period of 15 days.
Upon confirming receipt of the product, establishing the defect/damage, Furjan winery will order a refund or confirm delivery of a correct product.
Consumer Dispute Resolution
We inform you that all disputes are resolved amicably. You also have the right to use out-of-court dispute resolution mechanisms by filing with the Honorary Court of the Croatian Chamber of Commerce or submitting a proposal for mediation at the Mediation Center of the Croatian Chamber of Commerce.

Liability for Material Defects
Under the Obligations Act (Articles 400-422), we are liable for material defects that existed when the risk transferred to the Buyer and for defects appearing after the transfer if due to prior causes.
Under Article 403, Buyers must inspect received goods as soon as possible and report visible defects within 8 days.
Use and Protection of Personal Data
The Privacy Policy is an integral part of the Terms of Use and governs the use of information that Furjan winery will collect from you when you visit Furjan winery websites, register, make a purchase, or provide information to Furjan winery customer service if you contact us by phone.
As a registered Furjan winery user, you will receive your own user account (hereinafter referred to as the “User Account”). Furjan winery advises you not to disclose your User Account information to anyone. You are solely responsible for maintaining the confidentiality and security of your User Account and for all activities that occur on or through your User Account.

Buyers are required to read and agree to the General Terms upon registration, which apply to each subsequent purchase until they are amended. Buyers will be informed of any changes at their next purchase following the modification. Vina Furjan assumes no responsibility for a Buyer’s failure to do so.
Jurisdiction
For all disputes arising from the use of the website https://www.vinafurjan.hr, the competent court in Varaždin shall have jurisdiction.
